Czechpoint supports and adheres to ABTA guidelines and principles

By using this web site (the "Web Site") you acknowledge that you have read the terms and conditions of use and you agree to the terms and conditions thereof. YOU AGREE TO READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE WEB SITE. If you do not agree to these terms, you may not access or otherwise use the Web Site.

I understand that Czechpoint is not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold Czechpoint responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or other inconvenience.

I accept that Czechpoint is not responsible for, nor will I attempt to hold it liable for any injury, damage or loss I may suffer for any conditions, actions or omissions that are beyond the reasonable control of Czechpoint.

I will review my travel documents for accuracy upon receipt and understand that I may contact Czechpoint if I have any questions. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money. Any inaccuracies must be reported to Czechpoint within 48 hours of receipt of travel documents or it may not be possible to make changes.

I understand that if travelling internationally, I must have a valid passport and depending upon my destination and the origin of my passport, I may need to obtain a visa.

I understand that I may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

Czechpoint RECOMMENDS THE PURCHASE OF MEDICAL INSURANCE

The Web Site is owned and operated by Czechpoint. All information, including, without limitation text, graphics, software and all HTML, CGI and other codes and scripts in any format used to implement the Web Site ("Content") are the property of Czechpoint. The Content on the Web Site is for personal use only. You may not copy, modify, upload, download, transmit (re) publish, or otherwise distribute any content from the Web Site except as expressly permitted by these terms and conditions.

Copyright Law, Trademark Law and applicable international treaties and conventions governing intellectual property law protect all Content on the Web Site.

On the Web Site, Czechpoint provides access to travel-related services provided by third parties that Czechpoint does not control. Czechpoint is not responsible for breach of contract or any intentional or negligent action on the part of such third party suppliers, which results in any loss, damage, delay or injury to you or your travel companions. Czechpoint does not guarantee any such suppliers' rates, bookings, reservations, connections, scheduling or protection of personal belongings, unless the word "guaranteed" is specifically stated on your tickets, travel itinerary or invoice. Furthermore, Czechpoint assumes no responsibility for overbooking, cancellation or delays for hotels and transport, including airlines.

Travellers who use the Web Site, assume full responsibility for, and hereby release Czechpoint from any duty of checking or verifying any passport, visa, vaccination or other entry requirements for chosen destinations. Travellers are also fully responsible for verifying all safety and security conditions for each destination. You agree that Czechpoint is not responsible for any potential risks and hazards associated with travel to destinations listed on the Web Site. Without limiting the generality of the foregoing, Czechpoint assumes no responsibility for standards of hygiene, cuisine, sanitation, medical treatment or telecommunications services. Nor is Czechpoint responsible for any political instability, terrorist activity, war, social or labour unrest, civil disturbances, arbitrary changes in government policies, local laws or customs, climatic conditions, methods of conducting business, military activity or emergency evacuation methods. By embarking on travel arranged through, or utilizing information contained on, the Web Site, you voluntarily assume the risks associated with such travel.

Czechpoint shall not be responsible for any damage to or loss of luggage or personal items. Czechpoint RECOMMENDS THE PURCHASE OF TRAVEL INSURANCE. Travellers should consider obtaining travel insurance from a licensed insurer. All incidents of damaged, lost or stolen luggage should be reported in writing directly to your insurance company. Note that most airlines permit a maximum of two checked in bags and one carry-on piece. All excess luggage will be subject to additional charges by the airline.

Some of the Content that refers to transportation, hotel accommodations, restaurants and other services is the property of, and is supplied by, independent suppliers and is not under our control. Czechpoint does not verify, and does not guarantee, the accuracy of the information that we receive from third party vendors, including suppliers of transportation and accommodations. All information, prices and availability are subject to change without notice.

THE ACCURACY AND RELIABILITY OF THE CONTENT ON THE WEB SITE IS NOT GUARANTEED. THE CONTENT FROM OR THROUGH THE WEB SITE IS PROVIDED "AS IS" AND ALL WARRANTIES, EITHER EXPRESS OR IMPLIED ARE DISCLAIMED INCLUDING WITHOUT LIMITATION, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CZECHPOINT ASSUMES NO LIABILITY FOR ANY ERRORS, BUGS, VIRUSES, OMISSIONS OR OTHER PROBLEMS WITH THE CONTENT ON THE WEB SITE. TO THE FULLEST EXTENT OF THE LAW, CZECHPOINT MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER WITH RESPECT TO THE CONTENT ON THE WEB SITE OR THE MATERIALS, INFORMATION AND FUNCTIONS MADE ACCESSIBLE BY THE SOFTWARE USED OR ACCESSED THROUGH THE WEB SITE, FOR ANY PRODUCTS OR SERVICES OR HYPERTEXT LINKS TO THIRD PARTY SITES OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE WEB SITE OR ANY FURTHER LINKED SITE.

IN NO EVENT IS CZECHPOINT LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT ARE DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SERVICES ON THE WEB SITE.

Czechpoint agrees to adhere to all applicable local laws and industry practices relating to the collection and use of personal information from Web Site visitors.

This agreement represents the entire understanding between you and Czechpoint. The traveller's retention of tickets, reservations, tour documents, invoice or bookings after issuance, shall constitute consent to the above terms and conditions.

GENERAL BUSINESS CONDITIONS

1. BOOKING PROCEDURE
‘THE CZECHPOINT PARTNERSHIP’ will only accept bookings and enquiries from clients in writing (fax, letter, E-mail). Phone booking enquiries must be accompanied by written form before the end of the day when the booking occurred. Bookings should preferably be in English and must include the following information:

-exact dates or alternative dates
-name of the hotel (in case no particular hotel is requested, then hotel category or type must be stated as well as the price range and preferred location)
-name of the client, number of persons with type of room required
-list of additional services, trips and tours required
-contact numbers (fax and phone) and addresses
‘THE CZECHPOINT PARTNERSHIP’ will reply, at the latest, within 2 working days of receiving your booking and will either confirm your booking or request further details or more time to process your requirements. Confirmation from ‘THE CZECHPOINT PARTNERSHIP’ will include the following information :
-dates (arrival, departure) and name of the hotel with indication of category
-number of persons and room specifications with prices
-confirmation of services with prices
-cancellation fees and conditions of payment
All clients of ‘THE CZECHPOINT PARTNERSHIP’ are obliged to reconfirm and return the confirmation of booking received from ‘THE CZECHPOINT PARTNERSHIP’.

2. LIABILITY
In all travel arrangements ‘THE CZECHPOINT PARTNERSHIP’ acts as a travel agent for hotels, transportation companies, restaurants, theatres and other contractors and may not be held in any way responsible for losses, damage, accidents, delays, default or disruption of the tour by force majeure or other events beyond the control of ‘THE CZECHPOINT PARTNERSHIP’ agents; this applies particularly to programmes and other schedules.

3. PRICES
All the prices are stated in EURO or GBP and are based on tariffs and rates of exchange as of January 2008 and are subject to change and confirmation at the time of booking. Rates are subject to change without notice. Any changes in the economic climate, fluctuations in exchange rates, prices, official tariffs, charges and taxes may cause changes in the published rates. In such cases partners will be informed immediately.

4. PAYMENT
Immediately on receiving the final confirmation of booking ‘THE CZECHPOINT PARTNERSHIP’ will issue an invoice for the total amount. This invoice has to be paid before arrival by bank transfer or by credit card. The client must send ‘THE CZECHPOINT PARTNERSHIP’ a copy of the bank order to arrive no later than a minimum of 35 days prior to the clients' arrival as evidence that payment has been made.

The total balance could also be paid by credit card (VISA, EURO/MASTERCARD). In case of credit card payment the total invoiced sum will be increased by 3.0 % (fee which is collected by credit card companies). If the period between clients' booking and clients' arrival is less than 35 days, then the invoice issued must be paid immediately unless otherwise specified. Services requested will only be provided after the total invoice has been paid unless otherwise specified.

6. WITHDRAWAL FROM CONFIRMED BOOKING BY CLIENT CANCELLATION POLICY:

Individuals
7 working days prior to arrival: free of charge
6–2 working days prior to arrival: fee of 100% of the first night price
Less than 2 working days prior to arrival: fee of 100% of the total price

Groups
35 working days prior to arrival: free of charge
30–21 working days prior to arrival: fee of 35% of the first night price
20–8 working days prior to arrival: fee of 50% of the total price
7 or fewer working days prior to arrival: fee of 100% of the total price

Every hotel has its own cancellation conditions. Clients will be informed about cancellation conditions for particular hotel on the confirmation sheet. If not specified then the above-mentioned conditions shall be applied.

Cancellation must be done only in writing and comes only into force on the day when it is received and reconfirmed back by ‘THE CZECHPOINT PARTNERSHIP’. ‘THE CZECHPOINT PARTNERSHIP’ shall reconfirm the cancellation at latest within 24 hours. The client must always request ‘THE CZECHPOINT PARTNERSHIP’ to reconfirm back the cancellation as evidence that reservation has been cancelled and that the cancellation has in fact been effected.

7. WITHDRAWAL FROM THE CONFIRMED BOOKING BY ‘THE CZECHPOINT PARTNERSHIP’
‘THE CZECHPOINT PARTNERSHIP’ can only withdraw from the confirmed booking when the client does not pay on time and does not respect the conditions of payment and terms of ‘THE CZECHPOINT PARTNERSHIP’ and when the services confirmed in the booking cannot be provided for reasons of force majeure and the client refuses other replacement services.

8. REFUNDS
Refunds for inadequate services provided by ‘THE CZECHPOINT PARTNERSHIP’ must either be claimed by the client in person immediately from ‘THE CZECHPOINT PARTNERSHIP’, or through the partner travel agency who arranged the booking, in writing and within maximum 14 days of the day on which the event occurred. Assessment and settlement of claims will be carried out in accordance with the rates and procedures prevailing under Czech law.
